1. Acceptance of Terms

By accessing or using the Service in any way, you represent that: (1) you have read, understand, and agree to be bound by these Terms, (2) you are of legal age to form a binding contract, (3) you are not barred from using the Service under applicable laws.

2. Description of Service

LoveText is a messaging service that allows users to send anonymous, positive messages to people in their contacts. The service operates as follows:

• Predefined Messages: All messages sent through LoveText are predefined by us. Users select from a curated set of positive, uplifting messages. Users cannot create custom message content.
• Anonymous Delivery: Messages are delivered anonymously to recipients. The sender's identity is not revealed.
• Contact Access: By using our service, you agree that LoveText will have access to your contacts to enable core app features.

3. User Accounts

To use certain features, you may need to register an account. You are responsible for maintaining the confidentiality of your account and for all activities under your account. You agree to provide accurate information and to update it as necessary.

4. SMS Communications

LoveText may send SMS messages under the following strict conditions:

• Limited Use: SMS is used exclusively for account verification or to notify users that they have received a message through LoveText.
• One SMS Maximum: Each user can receive a maximum of one (1) SMS message during their entire lifetime as a LoveText user. We do not send marketing messages, reminders, or any other type of SMS communication.
• Legal Compliance: All SMS communications comply with applicable laws and regulations in the recipient's country, including but not limited to TCPA (United States), GDPR (European Union), and other local telecommunications regulations.
• Opt-Out: Recipients can opt out of receiving any SMS by replying STOP. Once opted out, no further SMS will be sent to that number.

5. User Conduct

You agree not to use the Service to:

• Attempt to circumvent the predefined message system
• Use the Service for harassment or stalking
• Impersonate any person or entity
• Send messages to contacts without having a legitimate relationship with them
• Violate any applicable laws or regulations
• Attempt to interfere with the proper functioning of the Service

6. Payments

Our Service uses a pay-per-use model ($0.99 for 5 messages). Payments are processed through Apple In-App Purchase or Google Play Billing. All payments are non-refundable except as required by law.

7. Privacy Commitment

At Astronware LLC, we believe privacy is a fundamental right. Our commitment to you:

• Minimal Data Collection: We only collect your phone number and an optional display name. That's it.
• No Tracking: We do not use App Tracking Transparency (ATT) or any cross-app tracking technologies.
• No Ads: LoveText is and will always be ad-free. We don't sell your data to advertisers.
• No Third-Party Analytics: We don't share your data with analytics providers.

8. Intellectual Property

The Service and its content, features, functionality, and predefined messages are owned by LoveText and are protected by copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT GUARANTEE DELIVERY OF MESSAGES VIA SMS.

10. Limitation of Liability

IN NO EVENT SHALL LOVETEXT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES RELATED TO MESSAGE DELIVERY OR NON-DELIVERY.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
